1. Who we are and what these Terms cover

These Terms of Service (“Terms”) govern your access to and use of the website motorbikehorse.com (the “Site”) and your purchase of any products offered through it (“Products”). The Site is operated by Motorbikehorse, a company registered in Texas (“MotorbikeHorse”, “we”, “us”, “our”).

By accessing the Site or placing an order, you agree to be bound by these Terms, our Shipping Policy, our Returns & Exchanges Policy, and our Privacy Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Site.

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to purchase from the Site. By ordering, you confirm that you meet this requirement and that all information you provide is accurate and complete.

3. Rider safety — read this section carefully

Motorcycling is an inherently dangerous activity that can result in serious injury or death. You acknowledge and accept this risk as a condition of purchasing and using our Products.

Our protective garments are designed to reduce the risk or severity of certain injuries in certain conditions. No garment, armor, or protective product can prevent injury or death in all circumstances, and we make no representation, warranty, or guarantee that any Product will protect you from injury in any accident or impact.

Where a Product carries a certification rating under EN 17092 or an armor rating under EN 1621, that rating reflects performance in standardized laboratory tests only. It is not a prediction of real-world outcomes. Protective performance further depends on correct sizing, correct fit, correct armor placement, garment condition, and proper care in accordance with the care instructions supplied.

Any Product involved in a crash or significant impact may have compromised protective capability even where no damage is visible, and should be retired from protective use. Protective gear is a supplement to — never a substitute for — safe riding, rider training, and compliance with applicable traffic laws and helmet laws.

4. Product information and certification claims

We take care to describe our Products, their materials, and their certification status accurately. Certification ratings stated on the Site apply only to the specific garment models and versions tested, as documented in the applicable certificates held by us or our manufacturing partners. Colors may render differently on different screens. Minor variations in materials and finish may occur between production batches.

If you believe any Product description or certification statement on the Site is inaccurate, contact us at info@motorbikehorse.com and we will investigate promptly.

5. Orders, acceptance, and refusal

Your order is an offer to purchase. Our order confirmation email acknowledges receipt of your offer; a contract is formed only when we dispatch the Products. We may refuse or cancel any order before dispatch — including for suspected fraud, pricing or stock errors, or delivery restrictions — in which case any payment taken will be refunded in full.

We may limit quantities per customer, per household, or per order at our discretion, including for resale prevention.

6. Pricing, payment, and errors

All prices are stated in US dollars unless otherwise indicated and include any applicable taxes, duties, and shipping charges except where our Shipping Policy states otherwise. We may change prices and product availability at any time; the price applicable to your order is the price displayed at checkout when you place it.

If a Product is listed at an obviously incorrect price due to a typographical or system error, we may cancel the order and refund you in full, even after an order confirmation has been sent, provided the Products have not yet been dispatched.

Payment is processed at checkout through our third-party payment providers. We do not store your full card details.

7. Shipping, delivery, returns, and exchanges

Dispatch times, delivery estimates, destinations, duties, and carrier terms are governed by our Shipping Policy. Returns, exchanges, refund conditions, and damage claims are governed by our Returns & Exchanges Policy. In the event of any conflict between those policies and this document on those subjects, those policies prevail.

8. Warranty and disclaimers

Except as expressly stated in these Terms or required by applicable law, the Site and the Products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits any statutory consumer rights that cannot be waived under the law of your place of residence.

9. Limitation of liability

To the fullest extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, arising from your use of the Site or the Products; and (b) our total aggregate liability arising out of or relating to any order shall not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including for death or personal injury caused by negligence where such exclusion is prohibited, or for fraud.

10. Indemnification

You agree to indemnify and hold harmless MotorbikeHorse, its owners, officers, and personnel from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your violation of any law or third-party right.

11. Intellectual property

The Site and all content on it — including the MotorbikeHorse name, logo, product names, photography, text, designs, and graphics — are owned by or licensed to us and are protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Site content without our prior written consent, except for personal, non-commercial viewing.

12. User content and reviews

If you submit reviews, photos, comments, or other content to the Site or tag us on social platforms, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content in connection with the Site and our marketing, and you confirm you have the rights to grant it. We may remove user content at our discretion, including content that is unlawful, misleading, infringing, or abusive. We do not compensate for user content unless separately agreed in writing.

13. Acceptable use

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorized access to any systems; scrape, harvest, or copy Site content or data at scale; interfere with the Site’s operation; place fraudulent orders; or misrepresent your identity. We may suspend or terminate access for violations.

14. Third-party links and services

The Site may contain links to third-party websites and services, including payment providers, carriers, and social platforms. We are not responsible for their content, policies, or practices. Your use of them is at your own risk and subject to their terms.

15. Governing law and disputes

These Terms are governed by the laws of the land.

16. Changes to these Terms

We may update these Terms from time to time. The version in force when you place an order applies to that order. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The “Last updated” date at the top of this page reflects the current version.

17. General

If any provision of these Terms is found unenforceable, the remainder continues in full force. Our failure to enforce any provision is not a waiver of it. These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding the Site and your purchases. We may assign our rights under these Terms in connection with a business transfer; you may not assign yours without our written consent.
